Men Charged In Homeless Man's Death Won't Face Death Penalty
Fetty's Naked, Beaten Body Found In Trash Bin

CHILLICOTHE, Ohio -- Two men who were charged with aggravated murder will not face the death penalty, according to a published report.
The Chillicothe Gazette reported that the death penalty is no longer a factor regarding Martin Baxter and Matthew Ferman, who are charged with the death of Daniel Fetty.
Baxter and Ferman are in the Ross County Jail and are being held under $1 million bonds, NBC 4 reported.
Authorities found Fetty's naked body in a trash bin. He had been beaten, NBC 4 reported.
Prosecutor Rob Junk told the newspaper the death penalty is no longer a factor because the men were not indicted on an aggravated robbery charge they originally faced.
He also said that Fetty was gay, and authorities are looking at the murder as a possible hate crime.
